Hey Transbuddha,
Your Top Ten Transformer list is a really great, I totally had Grimlock and several other dinosaur transformers, Stegasaurus and Brontasaurus, not sure what their names were. Jetfire is pretty sweet looking, I wish I had had one of those, secretly I wish to rebuild my collection. You can post this to our site and then link back to your site. We are looking for top ten lists and our users can track back to your site. The coolest feature is you can let other people vote on the rankings of your list.

You are hosting a video which is in violation of the DMCA.

http://www.transbuddha.com/content/why-i-got-fired-from-apple/

This is an unauthorized use of this material, please remove it.

Failure to remove this material will result in complaints to your hosting provider, etc.

I own the rights to portions of that video, if you want to contact me to see which portion, email skoobsey@yahoo.com and I will also give you a full and formal DMCA request at that point. If you are Eric Ott, you have already been notified of the DMCA violation in a manner that met all full and legal requirements.

thank you,

Wow. That has to be the longest gap between post and takedown notice ever. Obviously you’re a very busy man, otherwise you’d realize that by publicly bringing attention to your ‘portion’ of a rights violation a full THREE YEARS LATER, all you’re doing is drawing attention to a post that even I had forgotten about. Well done, sir. Well done, indeed.

Actually, no. Now is when you post the full and formal DMCA request so Buddha Team Legal can judge whether it has merit. You’ll pardon me if I have trouble taking a yahoo.com e-mail address seriously. I mean, really now…

Reply

30 MRN April 22, 2009 at 8:32 am

Eric Ott, you have already been served with a full DMCA. Now it goes to your ISP, and I also noticed Internic violations in your registation data. Those have been reported as well. I am not required to publically post anything, and you already have a formal DMCA takedown. I will give you 24 hours to remove the content.

Reply

31 MRN April 22, 2009 at 8:34 am

I will also contact google.com, as they will de-index a site that refuses to respond to a DMCA notice.

Reply

32 .alphamonkey. April 22, 2009 at 8:39 am

Um….. I’m not Eric Ott, nor is anyone associated with this website Eric Ott. You haven’t really thought this through, have you?

Reply

33 .alphamonkey. April 22, 2009 at 8:40 am

Oh, and hey.. you know that I have legal recourse when it comes to frivolous or fraudulent DMCA takedown notices, right? So you just go ahead and show me the documentation.

Reply

34 MRN April 22, 2009 at 8:52 am

Provide an email address to send the DMCA too if you are not Eric Ott. Otherwise you remain in violation. The video you are hosting is pirated media, no performers signed any contractual releases for its use. Apple computer does not even have those rights. I assure you, I represent one of the performers and this is documented in the DMCA takedown notice.

Reply

35 MRN April 22, 2009 at 8:58 am

or provide a street address that can recieve registered mail, these are your options under the law.

Reply

36 .alphamonkey. April 22, 2009 at 9:02 am

“Pirated media”? I must have blacked out all the scenes with buccaneers and peglegs, due to massive childhood trauma.

But hey.. I’m sure you are more than familiar with the term ‘fair use’, right? Right?

alphamonkey@transbuddha.com (which seems like a no-brainer to me, but anywho). By all means, send away. Though I hope you send it from something other than a yahoo.com e-mail address, which is like a guaranteed spam filter trip.

Reply

37 MRN April 22, 2009 at 9:25 am

You have no right to ignore an email from the yahoo.com domain. Failure to respond in the legally appropriate manner and time limit will garner you the statutory penalties. Fair use does not cover the infringement you have committed, not any stretch of the imagination or the stated laws of the United States of America in accord with international treaty as well.

Reply

38 MRN April 22, 2009 at 9:26 am

Copies of this DMCA notice will be CC’d to your hosting provider, etc.

Reply

39 .alphamonkey. April 22, 2009 at 9:32 am

I’m not aware that I have an obligation to look at ANY e-mail. My point was that a yahoo.com e-mail address has a higher likelihood of being flagged by software spam filters. Not to mention that whole ‘wow, you don’t even bother to have a company e-mail address? Classy!’ thing.

I love that you’re Threats McThreat-Threat without ever actually disclosing what exactly the violation is or which rights in particular you represent. Does this approach actually work with anyone? I bet you’re fun on dates.

Obviously you have a lot of time on your hands, but you could have shortened this whole process considerably via a less blitzkrieg approach. I mean, seriously…it’s not like anyone is losing money over this.

I’d have to concur, the adversarial lawyered-up approach you took threatening punitive action when you hadn’t even done the due diligence as to check to see who it was you need to talk with or to send your documentation (and it’s not hard to find on this site) was your first mistake.

Being a complete asshole was your second.

For future reference, as I am assuming you are scowering for all instances of this crime against humanity and threatening any site which deemed to show it, if you had simply sent out a more politely phrased heads-up message (to the right person, aka the site admin, our beloved alphamonkey), backed with documentation, you would engender less hostility and distrust towards your position.

You catch more flies with honey than with douchebaggery.

Hey Transbuddha,

I know you’ve posted thousands of links over the years so the odds that you might remember one in particular are pretty slim.

Still here goes…

The post regarded a holiday movie. possibly German and quite old (30′s or 40′s maybe) You noted that the film was a holiday classic in Europe much like “It’s a wonderful life” or “Miracle on 34th St.” here. Much of the film involved an interaction between a servant and the Lady of the House around a formal dinner table.

I think this was posted 3 or 4 years ago but I’ve browsed though the archives without luck. Do you remember the name of the film?

Reply

84 Arhu December 15, 2009 at 6:20 pm

@critter911: Being from Germany, this is easy. The half-hour show is called “Dinner for One”. Over here it is broadcast on several TV stations every year on New Year’s Eve, just like the Last Unicorn is shown every Christmas. Never gets old.

Hi there,

you linked to my game “Attracting Twist!” some month ago. I have released a new game “Chain Connect”, which goes the relaxation approach and is quite different. You might like it.

Not that I expect you guys to feature any of this stuff, but as a long time reader of the Buddha, I thought I’d share this with some of my interfriends:

Here’s a couple of things I’ve been working on!

1) I started a record label. Transbuddha featured my band a long time ago (Polymaths), and now there’s a whole group of bands that have joined together! That’s at http://www.urbanplanningrecords.com.

2) I also started a videogaming website with a couple of friends. We’re trying to cover videogames in a non-stereotypical, somewhat critical and intelligent way. If that’s something you’re interested in, that’s at http://www.vigigames.com.

OK! Thanks for hearing me out. Keep rockin’ it, Buddha!

Hey there!

Long time reader first time link submitter. Love the stuff on here. I’ve been reading since 2004. Here is an animation project I’ve worked on for the past year. I don’t know if it is Transbuddha worthy but give it a look see.

additional comic and production notes are available but there is no website yet.

Best,
Charlie
